Attorney Biography

Mr. Agatston not only has extensive experience in pursuing civil claims for crime victims, but has numerous contacts with professionals in the mental health field who have specific expertise in the counseling services for the survivors of these horrific crimes.

Working with victims and survivors of crime, and their families, to pursue their civil remedies is more than a professional calling for Mr. Agatston.  He also has provided, and currently provides, free, pro-bono legal services to organizations whose mission is to offer comprehensive services for children who are alleged to have been sexually abused, or suffered severe physical abuse.

Additionally, in November 2002, Mr. Agatston was appointed to the Executive Board of the Children's Advocacy Centers of Georgia.  When his term ended in 2009, he was appointed to its Advisory Board, where he currently serves.  He is also a member of the Coalition for Child Abuse Prevention; the American Professional Society on the Abuse of Children; and the Sexual Abuse Litigation group of the American Association for Justice.  Additional affiliations include the State Bar of Georgia, the Georgia Trial Lawyers Association, the American Bar Association as well as the ABA's Litigation Section, and the American Association for Justice.

As of February 2013, Mr. Agatston was appointed to the interim management team of the Children's Advocacy Centers of Georgia, the statewide organization that supports, mentors, trains, and assists Georgia's 40 Children's Advocacy Centers throughout the state of Georgia.  Additionally, as it relates to children's advocacy centers, Mr. Agatston consults CACs nationwide not only in in-person trainings, but through a national Listserv for professionals who work in and with children's advocacy Centers.  Details on the "Legal Eagle" Listserv can be seen on this website, on the "Legal Eagle Listserv for CACs" page.

Mr. Agatston's practice has always included claims for injuries arising out of automobile collisions.  In fact, he has settled or tried more auto claims than any other area of practice, settling hundreds of such claims and serving as lead trial counsel in at least 60 civil jury trials (he stopped counting years ago).  He has tried cases in multiple counties throughout Georgia.  Mr. Agatston is also experienced in premises liability claims, intentional tort claims, and in fact, most claims arising out of personal injury.

At AgatstonLaw, we believe that giving back to the community is paramount.  It is both a duty and an honor.  AgatstonLaw's Adopt-A-Mile is not always the cleanest mile in Georgia, but four times a year it is!  And Mr. Agatston's pro bono service, extending back to 1998, centers around cases and causes involving child advocacy.  That service is alive and well in Georgia, but for the past five years Mr. Agatston has provided pro bono legal expertise to Children's Advocacy Centers across the United States through his Legal Eagle Listserv.  The Listserv is subscribed to by more than 700 Children's Advocacy Center professionals and their affilated professionals such as medical professionals, therapists, prosecutors, law enforcement, social services, and forensic interviewers, in approximately 48 states as well as two Indian Territories!

The articles written and sent to CAC professionals and those affiliated with CACs make up a collection of four books:

1. 2009 book, The Legal Eagles of Children’s Advocacy Centers: A Lawyer’s Guide to Soaring in the Courtroom;

2. 2010 book, The Legal Eagles Guide for Children’s Advocacy Centers, Part II: Soaring Confidently in the Courtroom;

3. 2012 book, The Legal Eagles Guide for Children’s Advocacy Centers, Part III: Soaring for Advocacy and Justice;

4. 2014 book, The Legal Eagles Guide for Children’s Advocacy Centers, Part IV: Soaring Higher for Children and Families;
